The Differences Between "Legal Custody" and "Physical Custody"

"Legal custody" refers only to the ability to make important decisions about the growth and development of the child. These decisions involve religion, health care, education and others. Legal custody is generally shared by both parents, and it does not refer to where or with whom the child will actually live.

"Physical custody" refers expressly to which parent the child will live with. In most cases, primary physical custody is granted to the mother and secondary custody and visitation rights are granted to the father. However, Mr. Gentry has had considerable success in getting primary physical custody for his male clients. If either parent wishes to move a significant distance away, then visitation schedules will have to be altered. In every case, the parent who doesn't have primary physical custody of the children is required by law to pay child support.

If either parent fails to honor the terms of the child custody and visitation decree, then he or she can be held in contempt.
